Rich Sense Terms of Service

Rich Sense is a free browser-based daily word and trivia game featuring topics that may include money, business, brands, entrepreneurship, lifestyle, culture, wealth, success, and related subjects. The Site may include daily games, archived games, scores, streaks, crowns, affirmations, humorous commentary, informational content, and other features. We may add, modify, suspend, or remove features from time to time.

You must be at least 13 years old to use Rich Sense. If you are under the age of majority where you live, you should use the Site only with the permission of a parent or legal guardian. Rich Sense is not directed to children under 13.

Rich Sense currently does not require users to create an account.

Game information such as your:

• current streak;
• longest streak;
• games played;
• daily score;
• crowns earned; and
• completed-game status

may be stored locally in your browser.

Because this information is stored on your device, it may be lost if you clear your browser data, use a different browser or device, browse privately/incognito, or otherwise remove locally stored information. We are not responsible for lost scores, streaks, crowns, or other locally stored game progress.

Rich Sense is designed primarily for entertainment. Although game questions and content may relate to money, investing, business, careers, entrepreneurship, wealth, products, companies, or other financial subjects, nothing on Rich Sense constitutes:

• financial advice;
• investment advice;
• tax advice;
• accounting advice;
• legal advice;
• business advice tailored to your circumstances; or
• a recommendation to buy, sell, invest in, or use any product, company, security, or service.

Do not make financial, legal, tax, investment, or business decisions solely on the basis of Rich Sense content.

We make reasonable efforts to create accurate and enjoyable game content. However, trivia, business information, brand information, historical information, financial concepts, and other facts may occasionally contain errors, become outdated, or be subject to interpretation.

Rich Sense does not guarantee that every question, answer, explanation, Rich Take, affirmation, or other piece of content will be complete, current, or error-free. If you believe we made an error, you may contact us.

Rich Sense may establish rules relating to:

• daily games;
• guesses and attempts;
• scoring;
• streaks;
• Rich Words;
• bonuses;
• crowns;
• archived games; and
• sharing results.

We may change game rules or scoring systems in future versions. Scores, streaks, crowns, and other game achievements have no cash value and cannot be exchanged for money, goods, or services.

Archived games may be offered for practice or entertainment. Unless otherwise stated, archive play does not affect official daily scores, streaks, crowns, or other daily-game statistics.

You agree not to:

• use the Site for unlawful purposes;
• interfere with or disrupt the operation or security of the Site;
• attempt to gain unauthorized access to the Site, servers, code, or systems;
• introduce malicious code, viruses, bots, or automated attacks;
• scrape, copy, harvest, or extract substantial portions of the Site or game database without written permission;
• use automated systems to play or manipulate games, scores, or statistics;
• attempt to circumvent technical restrictions or security measures;
• reproduce or commercially exploit Rich Sense games or content without authorization;
• impersonate Rich Sense, Danko Labs, or Danko Studios Corporation; or
• use the Site in a way that infringes another person's rights.

We may restrict access to users who misuse the Site.

The Rich Sense name, branding, design, original game structure, written content, graphics, copy, game questions, Rich Takes, affirmations, and other original materials are owned by or licensed to Danko Studios Corporation and are protected by applicable intellectual-property laws.

You may use Rich Sense for your personal, noncommercial enjoyment.

You may share score results through the sharing features provided by the Site. No other license is granted unless we provide written permission.

Rich Sense games may occasionally reference companies, products, brands, public figures, or trademarks for trivia, identification, commentary, or informational purposes. All third-party trademarks and names belong to their respective owners. Reference to a third-party brand does not imply sponsorship, endorsement, partnership, or affiliation with Rich Sense or Danko Studios Corporation unless expressly stated.

The Site may contain links to websites or services operated by third parties. We do not control those third parties and are not responsible for their content, availability, security, privacy practices, products, or services. Visiting a third-party site is at your own discretion and subject to that site's terms and policies.

We hope to keep Rich Sense available and operating properly, but we do not guarantee uninterrupted access.

The Site may occasionally be unavailable because of:

• maintenance;
• hosting problems;
• software errors;
• internet outages;
• security issues;
• updates; or
• events beyond our control.

We may modify, suspend, or discontinue all or part of Rich Sense at any time.

To the fullest extent permitted by law, Rich Sense is provided “as is” and “as available.” Danko Studios Corporation disclaims warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

We do not warrant that the Site will always be secure, uninterrupted, accurate, or error-free. Some jurisdictions do not permit certain warranty exclusions, so some of these exclusions may not apply to you.

To the fullest extent permitted by law, Danko Studios Corporation and its owners, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Rich Sense.

This includes, without limitation, losses involving:

• money;
• profits;
• business opportunities;
• investments;
• data;
• game progress;
• scores;
• streaks; or
• reliance on information appearing on the Site.

To the extent liability cannot legally be excluded, the total aggregate liability of Danko Studios Corporation arising out of your use of the free Rich Sense service will not exceed $100, unless applicable law requires otherwise.

To the extent permitted by law, you agree to indemnify and hold harmless Danko Studios Corporation and its affiliates, officers, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

• your unlawful misuse of the Site;
• your violation of these Terms; or
• your infringement of another person's rights.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

We may update these Terms as Rich Sense changes. When we make material changes, we will update the Effective Date at the top of this page.

Your continued use of Rich Sense after updated Terms become effective constitutes acceptance of the updated Terms.
